DOWNING OF THE RUSSIAN AIRCRAFT VIOLATING TURKISH AIRSPACE: AN INVESTIGATION THROUGH THE INTERNATIONAL AGGREMENTS AND LAW
Abstract
The chaos environment, ongoing since 2011, when the grassroots movement has started has transformed Syria into a field of power struggle. The region has converted into an arena of struggle both for the local actors in Syria and for the regional and global powers trying to maximize their national benefits. As a result of the increasing intensity of the conflicts, the mass immigration waves have headed towards Turkey and the terrorist actions and activities have come to a state of threat for Turkey. Turkey, with approximately 900 km Syrian border line of the mainland, fell in a position to increase the defense measures at the border line, to provide her own security. In spite of the measures implemented, arising of the actual attacks against her military units and mainland by the Regime forces and terrorist organizations oriented Turkey to respond in accordance with the legal authorization of the common international law. One of these events was the case of shooting down a Russian SU-24 aircraft which violates the Turkish Airspace. The aim of the study is to investigate this case which is related to the security policy of Turkey, usually discussed on the axis of military, economics and Turkish-Russian bilateral relations perspective, with the dimensions of international treaties and legislation.
To that end, the bilateral and/or multilateral agreements, conventions and the domestic legal documents of Turkey were scanned with a critical literature review and the case was investigated with a descriptive methodology through the directly related documents. In conclusion, it is evaluated that the interception of the Russian Aircraft was legitimate within the frame of international and international legislation.
