ILO: Grev Hakkına İlişkin Kriz

Abstract

Bu çalışmanın amacı,  2012 yılında Uluslararası Çalışma  Örgütü Konferansındaki  işveren grubu tarafından grev hakkı ile
ilgili  yapılan sert itirazların
ILO’da  bir krize yol açıp açmadığının
incelenmesidir. Bu konu sadece Uluslararası Çalışma Örgütü denetim mekanizması
içtihatları ile sınırlandırılacak, diğer uluslararası çalışma normları
bakımından bir inceleme başka bir çalışmanın odak noktasını oluşturacaktır.











 ILO’da grev hakkı ne 87 sayılı Sendika
Özgürlüğü ve Örgütlenme Hakkının Korunmasına İlişkin  sözleşmenin metninde  ne de 98 sayılı Örgütlenme ve Toplu Pazarlık
Hakkı  sözleşmesinin metninde  yer almaktadır. 60 yıl boyunca grev hakkına
örgütlenme özgürlüğünün bir parçası olarak yer verilirken  , toplu sözleşme, sendika hakkı ve grev hakkı
bir bütün olarak düşünülmüştür. Bu durum ta ki 2012 yılındaki ILO Konferansı’na
kadar devam etmiştir. İşveren grubundan ciddi bir itiraz ile birlikte grev
hakkı ile ilgili ILO ‘da bir kriz olup olmadığı sorusu gündeme gelmeye
başlamıştır. İşveren grubunun daha önceki yıllardaki itirazlarına göre 2012
yılında yapılan bu itiraz oldukça sert bir itirazdır. İşveren
grubu grev hakkını ve buna bağlı olarak Uzmanlar Komitesinin ILO
standartlarının uygulanması konusundaki raporlarını sorgulamasıyla başlamıştır.
